Amundsen Davis assisted a developer in procuring funding for its $20 million development in the south-west suburbs of Chicago through a private placement offering, establishing corporate structure and preparing all necessary associated financial documentation.

The representation included negotiating loan documents with primary and secondary lenders, coordinating due diligence, preparation and negotiation of leases with health care providers and closing.

Amundsen Davis represented a developer in the redevelopment of a 582-lot subdivision by obtaining approval for an additional 117 lots and different types of housing, and providing a source of funding for the city water system from the developer. The firm drafted and negotiated the agreement with the city and obtained approval for the additional lots through an amended development plan.

Amundsen Davis successfully negotiated commercial leases on behalf of a corporation for its numerous multi-million dollar properties in preparation for a corporate acquisition.

Amundsen Davis was retained on the eve of trial and successfully defended a national distributor against a potential nine-figure punitive damages award, resulting in zero punitive damages assessed.

The firm successfully briefed and argued numerous motions which reduced our clients’ potential liability to six-figures, subsequently resulting in a favorable settlement.

Amundsen Davis obtained summary judgment on behalf of the owner of a construction project that caught fire during the course of the project, allegedly causing $4 million in damage to surrounding property owners.

Amundsen Davis defended a commercial building owner on a subrogation claim by a tenant’s insurance company seeking over $500,000 in damages to the tenant’s space. After briefing on a dispositive motion, the entirety of the complaint was dismissed with prejudice.

Amundsen Davis successfully negotiated the favorable settlement of a commercial leasing dispute between the client, a multinational commercial real estate firm, and its tenant, involving issues of partial constructive eviction and the inability of the tenant to meet certain lease obligations due, in part, to COVID-19 related shutdowns and restrictions.

Amundsen Davis represented an owner in its dispute with its contracted architectural firm relating to design work for an eight-figure multi-story residential condominium building in Chicago, reaching a favorable settlement.

Amundsen Davis defended a custom home-builder in a case brought against it by a homeowner seeking nearly $1 million in damages for alleged defects to the home. Following arbitration, a verdict was rendered for the client.

Amundsen Davis represented a developer in a case brought against it by one of its contractors seeking a six figure payment for work performed on nearly thirty different lots.  Following a trial, a verdict was rendered for the client, awarding the contractor nothing.

Amundsen Davis represented a general contractor in a case brought against it by one of its subcontractors seeking half a million dollars for work performed on multiple lots a residential subdivision.  After the subcontractor filed suit, we filed a counterclaim on behalf of the client.  Following a trial, a verdict was rendered for the client, awarding the subcontractor nothing and awarding the client six figures on its counterclaim.
